Robin Repass practices in the Labor and Employment Practice Group of the Firm’s Denver, Colorado, office. Her practice is focused on employment discrimination litigation, including civil and administrative litigation, employment law best practices training and counseling, advising and defending companies regarding reductions in force, including the Worker Adjustment and Retraining Notification Act (WARN), as well as advising and defending employers regarding discrimination claims under §105(c) of the Federal Mine Safety and Health Act (Mine Act), wage and hour issues under Colorado law and the Fair Labor Standards Act (FLSA), Family and Medical Leave Act (FMLA) issues, Equal Employment Opportunity Commission (EEOC) public enforcement actions litigation, unfair labor practice (ULP) defense, preparation and defense of covenants against competition and preparation of other employment forms, including severance agreements. Her experience includes defense of employers in multi‑plaintiff and complex litigation arising out of the employment relationship, such as defense of EEOC public enforcement actions and class action litigation based on the WARN Act. In addition, Ms. Repass also has experience in mass tort and complex litigation, personal injury litigation, products liability, civil trials, appellate work and motions practice.
Ms. Repass is also a member of the Occupational Safety and Health Practice Group, where her practice focuses on advising and defending operators and employers in discrimination complaints filed under §105(c) of the Mine Act in administrative litigation before the Federal Mine Safety and Health Review Commission (FMSHRC), as well as advising and defending operators and employers in state and federal civil actions arising from the employment relationship, including appellate representation and argument.
As a member of the Higher Education Industry Group, Ms. Repass advises and defends schools, colleges and universities in actions involving employees, as well as students, including Title IX of the Education Amendments of 1972, The Jeanne Clery Disclosure of Campus Security Policy and Campus Crime Statistics Act (Clery Act) and the Family Educational Rights and Privacy Act (FERPA).
Ms. Repass represents employers before the EEOC, Colorado Civil Rights Division (CCRD), National Labor Relations Board (NLRB), the Colorado and U.S. Department of Labor, the Federal Mine Safety and Health Review Commission (FMSHRC) and the U.S. Department of Education, as well as full representation at all local and federal trial court and appellate levels. Recent examples of her litigation experience include the following:
Defending NLRB unfair labor practice investigations and charges on behalf of employer;
Defending employers in litigation involving the Age Discrimination in Employment Act (ADEA), 42 U.S.C. § 1981 (racial discrimination), Title VII of the Civil Rights Act of 1964 (Title VII), Americans with Disabilities Act (ADA), Colorado Anti‑Discrimination Act (CADA) and retaliation‑based claims in state and federal courts of Colorado, to full trial verdict;
Representing employers in charges of discrimination filed with the EEOC and CCRD;
Briefing and arguing cases before the Tenth Circuit Court of Appeals in various employment discrimination matters;
Defending operators in hearings before the FMSHRC, Office of Administrative Law Judges, in discrimination claims under § 105(c) of the Mine Act; and
Defending employer as lead counsel in class action litigation under the WARN Act.
