Jackson Kelly PLLC has an extensive, nationally recognized environmental law department, involving all major environmental programs. The Environmental Department has attorneys that have practiced environmental law since the early 1970s, soon after the passage of the National Environmental Policy Act and the Clean Air Act and the establishment of the United States Environmental Protection Agency. The Department addresses a full range of environmental issues. Clients include individuals, as well as some of the nation's leading manufacturers, chemical companies, electric utilities, coal companies, oil and gas producers and distributors, waste disposal concerns and industrial firms.
Many of the Firm's clients retain the Department to represent them on policy issues at both the federal and state level. Through participation in activities of regulatory agencies, the legislative process and the judicial review of regulatory actions, the Department has become involved in some of the most significant federal and state environmental policy issues that have occurred in recent times. It has also been involved in administrative litigation and court of record proceedings related to permitting, enforcement, variances and citizen suits under such laws as the Surface Mining Control and Reclamation Act, Clean Air Act, Clean Water Act and Resource Conservation and Recovery Act. This representation is also extended to clients involved in CERCLA matters, including the recovery of natural resources damages.
Although litigation is an important part of the Department's services, the Firm is engaged frequently by clients to advise them how best to conduct their operations so as to avoid enforcement and litigation and to accomplish their business goals. The Department routinely advises clients with respect to permitting projects, environmental auditing, regulatory compliance and the development of factual records to support business decisions. In addition, lawyers frequently work with technical consultants to gather data and information to support the position of our clients.
