Brownfields

Despite the many inherent intricacies and complexities of Brownfields law, the attorneys of Jackson Kelly's Brownfields Practice have utilized their extensive experience and knowledge of environmental laws to complete a number of remediation and redevelopment projects, such as a petroleum site, a glass factory and a large retail development.

The attorneys in the Practice have enjoyed a long-standing involvement in and commitment to the area of Brownfields, having written extensively on Brownfields redevelopment and spoken regarding the West Virginia Voluntary Remediation and Redevelopment Program (WVVR&R Program).

The Brownfields practice provides counsel to clients regarding: the Federal Brownfields and WVVR&R Program, financing of Brownfields projects, EPA assessment and cleanup grants, the review of loan documents, prospective purchaser agreements, negotiation of land use covenants and certificates of completion, EPA revolving loan fund grants, prospective purchasers, institutional and/or engineering controls, windfall liens, site assessments, All Appropriate Inquiry Rule and risk assessments.

Attorneys in the Firm have served on a number of committees related to Brownfields, including: the technical subcommittee of the WVVR&R Program, the Environmental Committee of the West Virginia Chamber of Commerce and on various subcommittees of the West Virginia Chamber. Finally, Jackson Kelly's attorneys participated in the drafting of guidelines regarding the WVVR&R Program, as well as writing the section on the WVVR&R Program for the West Virginia Environmental Law Handbook.
