Wendy G. Adkins is a Member of Jackson Kelly's Litigation Practice Group and Higher Education Industry Group.

Ms. Adkins has experience representing members of limited liability companies in claims of breach of fiduciary duties; representing state entities concerning FOIA issues; representing higher education clients against challenges to procurement procedures and processes; representing employers against whistleblower, age discrimination, sex discrimination and wage and hour, defamation and sexual harassment claims; and representing businesses in suits against employees and independent contractors concerning breach of exclusivity or non-compete agreements.

Ms. Adkins is a summa cum laude graduate of West Virginia University where she obtained her Bachelor of Science degree in journalism in 2000. She graduated from the West Virginia University College of Law in 2003, where she was inducted into the Order of the Coif. She has been admitted to practice before the Supreme Court of Appeals of West Virginia, the Supreme Court of Pennsylvania, the United States District Court for the Southern District of West Virginia and the United States District Court for the Northern District of West Virginia.

Ms. Adkins has been named a West Virginia Super Lawyers® Rising Star for General Litigation Law since 2010. She was also named in the Top 20 under 40 in the November 2012 issue of Corridor Magazine.

Specific examples of Ms. Adkins' work include:


  • Served as the first chair litigator at trial in a dissolution action pending before the West Virginia Business Court Division
  • Litigated complex contract disputes, including but not limited to multi-year service contracts and covenants not to compete
  • Represented entities and individuals concerning claims of breach of legal duties owed by members of a limited liability company


  • Counseled employers on legal issues, including wage and hour, employee leave and benefit, reductions in force, drug testing and obligations under the Federal Medical Leave Act
  • Drafted and reviewed personnel policies and employee handbooks
  • Assisted in-house counsel, human resource representatives, managers and supervisors with employee discharge and discipline decisions
  • Represented employers in a wide range of employment litigation in state and federal courts, including wage and hour, employment discrimination, sexual and other unlawful types of harrassment, retaliation and wrongful termination

Higher Education

  • Represented a state higher education institution in promotion and tenure and other faculty grievances at level one conferences and hearings before the institution's chief grievance administrator
  • Represented a state higher education institution in a federal due process action related to academic integrity proceedings
  • Represented a state higher education institution in a state court action related to a procurement process
  • Represented a state higher education institution in a state court action related to a request made under the West Virginia Freedom of Information Act for an investigative report
  • Represented a state higher education institution in various state employment discrimination actions
  • Represented a state higher education institution in state court actions related to its public-private partnerships
  • Represented a state higher education institution in an arbitration concerning its statutory separation from a community and technical college


  • Represented clients before administrative law judges, state circuit court judges and federal district court judges throughout West Virginia for motion hearings
  • Drafted appellate briefs to the United States Supreme Court of Appeals, the United States Court of Appeals for the Third, Fourth and Tenth Circuits, as well as the Supreme Court of Appeals of West Virginia
  • Presented an appellate argument before an en banc panel of the Benefits Review Board concerning a federal administrative appeal
  • Represented and advised clients during mediations involving claims in excess of $1 million


  • Represented clients operating in the oil and gas industry throughout the Appalachian Basin in quiet title actions as well as "lease busting" actions
  • Represented clients appearing before administrative bodies that make planning and zoning decisions for municipalities
  • Represented a public utility in condemnation actions
