Thomas J. Hurney, Jr., handles the litigation and trial of cases involving serious personal injury and wrongful death.  Mr. Hurney now leads Jackson Kelly's Health Care and Finance Practice Group, after managing litigation groups for several years.

Mr. Hurney has been recognized by several organizations for his skill as a trial lawyer.  He was selected as Fellow of the American College of Trial Lawyers (ACTL) and an Advocate of American Board of Trial Advocates (ABOTA). He is rated AV Preeminent by Martindale-Hubbell and has been recognized in various peer publications, including The Best Lawyers in America®, Chambers USA - America's Leading Business Lawyers, Benchmark Litigation, Law & Politics' West Virginia Super Lawyers®  and Avvo. Super Lawyers recognized him as a Top Ten West Virginia Lawyer for five years. Super Lawyers® 2012 Magazine for Virginia and West Virginia featured an article on Mr. Hurney discussing his grandmother, who received her law degree in 1938. Chambers 2012 lists him as a "Tier 1" litigator in health care law and Benchmark recognized him as a Litigation Star.

Mr. Hurney has handled and tried a wide variety of cases, ranging from personal injury and product liability to insurance bad faith, contract and property law issues. He has significant experience defending industrial injury and "deliberate intention" actions, as well as environmental and commercial litigation. Recent trials include defending an action for injunction involving the Clean Water Act, a case involving violation of privacy and several medical professional liability cases.

Mr. Hurney's health care practice ranges from litigating and trying malpractice cases to actions arising from defective products and pharmaceuticals, including class and mass tort actions. He has handled a wide range of health care litigation, including peer review and licensing issues and administrative investigations. He worked on the legislative reforms to the MPLA in both 2001 and 2003 and has written extensively on the topic, including three law review articles.

Mr. Hurney has an active appellate practice, appearing before the West Virginia Supreme Court of Appeals over twenty times. He successfully defended, on appeal, the constitutionality of medical malpractice "caps" in McDonald v. City Hospital. In addition, he has appeared for amicus curiae in a variety of health care, products liability and deliberate intention cases.

Mr. Hurney is active in various bar and state and national legal associations. He is Chair of the West Virginia State Committee of the ACTL. He is Secretary of the Association of Defense Trial Attorneys (ADTA) and a member of the International Association of Defense Counsel (IADC) and DRI.  He is a past President of the Defense Trial Counsel of West Virginia, served on the Board of Governors of the West Virginia State Bar and has served on and chaired various bar committees, particularly its annual litigation seminar. He served as a member of the Executive Committee of the Kanawha County Bar Association.

Mr. Hurney is a frequent national speaker.  In 2012, he spoke at a national health care conference sponsored by the Boston University School of medicine and held in Costa Rica.  He spoke on trial themes at the annual DRI Trial Tactics seminar in Las Vegas.  He has spoken for DRI on defending negligent credentialing and privileging actions against hospitals and on defending obstetrical claims.  He has also spoken to state bar and defense organizations in several states on trial practice issues, including New Hampshire, Maine, Ohio, Vermont, Alabama, Iowa and West Virginia.

Mr. Hurney graduated from the University of Dayton with degrees in business administration in 1980 and law in 1983.  While at the UD School of Law, he was the comments editor of the Law Review and published his first article. In May, 2011, he was presented the Francis J.
