Benjamin J. Ross is an Associate in the Mining Law industry group, focusing primarily on litigation and workplace safety and health. He practices out of the Firm’s office in Denver, Colorado.
Ben represents clients in a variety of matters under the Federal Mine Safety and Health Act (MSHA), Occupational Safety and Health Act (OSHA), Motor Carrier Safety Improvement Act, and other state and federal statutes regarding compliance issues, policy, legislative and regulatory matters, civil and criminal enforcement issues, accident investigations, and special investigations.
Ben has successfully represented his clients to obtain MSHA citation modifications and has successfully defended MSHA discrimination complaints against mine operators. He’s also managed investigations that resulted in no citations.
For an associate, Ben has high-level experience. Ben previously served as a law clerk to the Honorable Richard W. Manning, Administrative Law Judge for the Federal Mine Safety and Health Review Commission, where he researched and drafted decisions and orders addressing agent liability, miner compensation, and discrimination claims. He regularly served as the settlement attorney for cases involving civil penalties and discrimination complaints. He also clerked for the Honorable D. Michael Fisher in the United States Court of Appeals Third Circuit.
Ben believes his work provides a valuable service for people, in that he is part of the system that strives to protect workers and businesses from unsafe practices. Meeting clients is rewarding for Ben, particularly if those meetings offer the opportunity to travel to the client. He loves learning the areas he’s only read about in the documents and seeing the facts of the case come to life as he matches names on a page to real people.
Whether traveling for work or pleasure, Ben makes sure to explore like a local wherever he goes, by taking advantage of local eateries and breweries. Ben once visited the world’s northern-most brewery, located on the Svalbard Archipelago of Norway. He loves all outdoor activities, particularly hiking, skiing, and backpacking. Also, even though he works out of the Firm’s Denver office, Ben still bleeds black and gold, rooting on all Pittsburgh teams from back home.
