On June 27, 2017, the U.S. Department of Labor’s Occupational Safety and Health Administration (“OSHA”) proposed a delay in the electronic reporting compliance date of the rule, Improve Tracking of Workplace Injuries and Illnesses, from July 1, 2017, to December 1, 2017. OSHA delayed the rule because the website to report electronic injuries was not yet live in June.

Although OSHA has not yet issued a final rule in the Federal Register to make the June 27, 2017, delay official, it did publish its website in early August. Employers now can access the website at https://www.osha.gov/injuryreporting/index.html by clicking the blue “Launch ITA” button on the right side of the page. The compliance date appears to remain as December 1, 2017. Employers can create a username and learn the system now, as the December date allows four months for employers to comply.

Please contact the author or Jackson Kelly if you have any questions about whether you have to comply with the new reporting rule.
