WORKPLACE EXAMINATION RULE – EFFECTIVE DATE

We have learned that the Mine Safety and Health Administration (“MSHA”) intends to extend the effective date of the Workplace Examination Rule until October 2, 2017. The Federal Register notice is now available for public inspection. MSHA has indicated that the additional delay will address commenters’ concerns regarding sufficient time for MSHA to inform and educate the mining community. The extension also affords MSHA more time to complete development of compliance assistance materials and conduct stakeholder meetings. We are still awaiting the Court’s ruling on the Petitioners’ Motion for Judicial Stay filed in the 11th Circuit. We will keep you updated as further information becomes available.
