The Jackson Kelly Commercial Litigation practice group has decades of business and commercial litigation experience.

Our litigators represent clients in numerous federal courts, including the United States Courts of Appeal for the Fourth, Sixth, and Seventh Circuits, District Courts throughout the United States, as well as many trial and appellate courts at the state level. Many of our attorneys are repeatedly recognized in The Best Lawyers in America® and are frequent speakers on a wide variety of topics relevant to commercial litigation.

Our attorneys routinely handle commercial disputes on matters such as antitrust litigation, intellectual property, coal, oil and gas, real estate, lending disputes, corporate (fiduciary duties), construction defects, defamation, software implementation, and RICO.   • Represents major corporations against all types of litigation claims and disputes
  • Represented employers in claims alleging occupational disease from worksite chemical exposure
  • Defending financial institutions and other creditors in individual and class action litigation involving alleged violations of state and federal consumer protection laws in connection with home mortgage loans, student loans, unsecured loans, automobile financing, credit card accounts, and consumer credit sales
  • Represented general contractor against public sewer district for claims for unpaid change orders, extras and delay damages involving waste water treatment plant
  • Represented general contractor against municipality challenging the award of a multi-million-dollar public project to the second-lowest bidder
  • Defended zoo against claims by unsuccessful bidder relating to large improvement project
  • Represented a prime mechanical contractor against a public university for claims relating to unpaid change orders and extras, interference and delay damages
  • Defended a general contractor in claims asserted by the owner alleging defects involving the construction of a large public library
  • Defended the owner and bonding company of a private shopping center from claims against the site excavator seeking damages for alleged unsigned change orders and/or extras, differing site conditions, etc.
  • Represented general contractor against municipal housing authority contesting the bid procedure utilized by the public authority involving a large housing project
  • Represented the public authority in claims against architect and sub-consultants relating to errors in the contract documents
  • Represented owner against contractor, architect and structural engineer alleging defects in the design and construction pertaining to various zoo structures
  • Defended general contractor in claims asserted by electrical contractor, which alleged unpaid change orders, delay and lost productivity
  • Represented numerous homeowners with regard to defects in construction of residential homes
  • Represented various contractors with respect to failure of various homeowners to make payment for changes in residential construction
  • Represented numerous suppliers and subcontractors with regard to filing mechanic’s liens and/or claims upon public funds (attested accounts) for materials furnished and/or work performed on private and public projects
  • Represented various developers in connection with the development and construction of residential and townhome developments
  • Represented homeowners’ association against contractors, design professionals and insurance companies, alleging defects in the design and construction of a large townhome community
  • Represented an electrical subcontractor with respect to claims for delay, acceleration and lost productivity relating to the construction of a large municipal swimming pool and fitness center
  • Represented general contractor against a large municipality for change orders, extras, delay and lost productivity relating to the construction of a sewer and pump station
  • Defended business clients as both plaintiffs and defendants in commercial disputes, including breach of contract, breach of fiduciary duty, fraud and misrepresentation, claims arising under the Uniform Commercial Code, tortious interference, and other business torts.
  • Represented businesses in a variety of commercial arbitration matters
  • Represented clients in state and federal courts in cases involving:
  • Represented the owner of a local business, which included the owner’s last name in the corporate name, in a dispute with another family member who opened an identical business (including the name) in close proximity to the client’s facility
  • Represented an agent of a national moving company in defending claims alleging misappropriation of more than $5 million relating to invoicing of clients
  • Represented various clients in the transportation industry, including intra-state carriers, interstate carriers and their commercial drivers, small trucking operations, regional trucking operations, and a major grocery transporter
  • Defending banking institutions, automobile dealerships, manufacturers and retailers of manufactured housing against various consumer claims
